API Terms of Service
1. Scope
These API Terms govern access to the ClarityRadar application programming interface (the "API"). They supplement our Terms & Conditions. Where the two conflict on anything to do with the API, these API Terms apply.
The API is offered to businesses only, not to consumers. By requesting an API key or sending a request, you accept these API Terms on behalf of your organisation.
2. API keys
We issue API keys to your organisation. You are responsible for every request made with your keys, whether or not you authorised it.
- Keep keys confidential and share them only with staff and contractors who need them.
- Tell us at legal@clarityradar.com as soon as you suspect a key has been exposed. We will revoke it and issue a new one.
- We may rotate or revoke a key at any time to protect the service, your account or the people being looked up.
3. Your responsibility
You decide why you run each lookup and what you do with the result, and you are responsible for that decision. You must have a lawful basis for every identifier you submit under the laws that apply to you and to the person concerned, and you are responsible for how you store, share and act on the results.
4. Prohibited uses
You may not use the API, or any result it returns, to:
- Make or support decisions about a person's eligibility for credit, housing, insurance, employment or tenancy. Results are not a consumer report, and ClarityRadar is not a consumer reporting agency under the Fair Credit Reporting Act.
- Stalk, harass, threaten or intimidate a person, or locate a person in order to cause them harm.
- Discriminate against a person on the basis of any legally protected characteristic.
- Resell, redistribute, sublicense or publish results, or build a data product that competes with the API.
- Build a dataset from results, or submit identifiers you do not have a genuine, individual reason to look up.
- Circumvent rate limits, geographic restrictions or any other technical limitation of the API.
- Carry out surveillance that is unlawful where you, or the person concerned, are located.
5. Face search
Face search is available only under a separate signed agreement. It is not available in the United States, the European Union, Iceland, Liechtenstein, Norway, the United Kingdom, Brazil, South Korea, Japan, Australia, South Africa, or the Province of Quebec, because of the biometric and data-protection laws in those places.
You must not use intermediaries, route requests or take any other step to get around these restrictions. Phone lookup has no geographic restrictions.
6. Requests, packages and billing
- One request is one identifier looked up once. A request counts whether or not the lookup returns any result.
- Access is sold as monthly packages at the prices and request allowances shown on the API page, or in a signed order form if you have one. Prices are in US dollars and do not include taxes.
- Requests are interchangeable across lookup types. Unused requests expire at the end of the billing month, except where your package says they roll over.
- You may cancel at any time. Cancelling stops the next month's charge; the current month is not refunded.
- If we suspend a key for a breach of these API Terms, no refund is due for the remainder of the billing period.
7. Speed and availability
Each lookup is a live check across several sources, so responses take seconds rather than milliseconds and response times vary. The API is not designed for decisions that must be made during a checkout.
We do not guarantee any particular uptime, response time or hit rate unless a signed order form says otherwise. Individual data sources can be slow or unavailable, and we do not guarantee that any specific source will be queried for a given request.
8. Results and accuracy
Results are compiled from public sources and third-party data providers. They are provided "as is" and may be incomplete, out of date, attributed to the wrong person, or wrong. You must verify a result before relying on it for any decision that affects someone.
9. How we handle lookup data
- Uploaded photos are deleted within 72 hours of the search.
- Lookup results are cleared 30 days after the lookup.
- We keep a record that a lookup took place, including the identifier, time, IP address and country, for billing and abuse investigations.
- Requests and responses travel over HTTPS.
- To perform a lookup, we send the identifier to third-party providers that run the individual checks, and the findings are passed to an AI model that writes a summary.
10. Suspension and termination
We may suspend or terminate your access, in whole or in part, if you breach these API Terms or we reasonably suspect abuse, if we are required to by law, a regulator or a court, or if a data provider we rely on restricts or ends our access to its data.
11. Disclaimer and limitation of liability
To the maximum extent permitted by law, the API is provided without warranties of any kind, express or implied, including warranties of accuracy and fitness for a particular purpose.
Neither party is liable for indirect, incidental, special or consequential damages, or for lost profits or revenue. Our total liability arising out of or relating to the API is limited to the fees you paid us for the API in the three months before the event giving rise to the claim.
12. Indemnification
You will defend and indemnify ClarityRadar against claims, fines and costs arising from your use of the API or its results, from your breach of these API Terms, or from lookups for which you did not have a lawful basis.
13. Changes to these API Terms
We may update these API Terms. We will email you about material changes at least 14 days before they take effect. Continuing to use the API after that date means you accept the updated terms.
14. Governing law and disputes
These API Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator, in Dover, Delaware.
